Our booking conditions and service terms

1. Acceptance of Terms

By accessing our website cash-crystal.com or booking any tours with Cash Crystal Tours ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

3. Booking and Payment Terms

3.1 Booking Process

  • All bookings must be confirmed in writing
  • A deposit of 30% is required to secure your booking
  • Full payment is due 30 days before departure
  • Bookings made within 30 days require immediate full payment

3.2 Payment Methods

We accept credit cards, bank transfers, and PayPal. All payments are processed securely through our certified payment providers.

3.3 Pricing

  • All prices are in Australian Dollars (AUD) unless stated otherwise
  • Prices include GST where applicable
  • We reserve the right to adjust prices due to currency fluctuations or increased costs
  • Price changes will not affect confirmed bookings

4. Cancellation and Refund Policy

4.1 Customer Cancellations

  • More than 60 days before departure: Full refund minus 10% administration fee
  • 31-60 days before departure: 75% refund
  • 15-30 days before departure: 50% refund
  • Less than 14 days before departure: No refund

4.2 Company Cancellations

We reserve the right to cancel tours due to:

  • Insufficient bookings (minimum numbers not met)
  • Safety concerns or adverse weather conditions
  • Circumstances beyond our control

In such cases, we will offer a full refund or alternative tour options.

4.3 Travel Insurance

We strongly recommend comprehensive travel insurance. We are not responsible for costs arising from cancellations due to personal circumstances, illness, or other unforeseen events.

5. Tour Inclusions and Exclusions

5.1 Included

  • Professional guide services
  • Accommodation as specified
  • Meals as listed in itinerary
  • Transportation during tours
  • Equipment and gear as needed
  • Entry fees to national parks and attractions

5.2 Excluded

  • International and domestic flights
  • Travel insurance
  • Personal expenses and gratuities
  • Alcoholic beverages (unless specified)
  • Optional activities and upgrades
  • Medical expenses

6. Health and Safety Requirements

6.1 Fitness Requirements

Participants must meet minimum fitness requirements for their chosen tour. We reserve the right to exclude participants who may endanger themselves or others.

6.2 Medical Conditions

You must disclose any medical conditions, allergies, or dietary requirements that may affect your participation. Failure to disclose relevant information may result in exclusion from the tour without refund.

6.3 Safety Compliance

Participants must follow all safety instructions and guidelines provided by our guides. Non-compliance may result in removal from the tour without refund.

7. Liability and Risk

7.1 Assumption of Risk

Adventure tourism involves inherent risks. By participating, you acknowledge and assume these risks. Activities may include but are not limited to:

  • Hiking and walking on uneven terrain
  • Water activities and snorkeling
  • Wildlife encounters
  • Remote area travel
  • Weather-related risks

7.2 Limitation of Liability

Our liability is limited to the tour price paid. We are not liable for:

  • Personal injury, illness, or death
  • Loss or damage to personal property
  • Consequential or indirect losses
  • Acts of third-party suppliers
  • Force majeure events

7.3 Indemnification

You agree to indemnify and hold harmless Cash Crystal Tours from any claims arising from your participation in our tours.

8. Conduct and Behavior

We expect all participants to:

  • Respect other participants, guides, and local communities
  • Follow environmental guidelines and Leave No Trace principles
  • Respect Aboriginal cultural sites and traditions
  • Refrain from behavior that may endanger safety or enjoyment
  • Not engage in illegal activities or excessive alcohol consumption

We reserve the right to remove participants who violate these standards without refund.

9. Itinerary Changes

We reserve the right to modify itineraries due to:

  • Weather conditions or safety concerns
  • National park closures or restrictions
  • Transportation issues
  • Operational requirements

We will provide suitable alternatives wherever possible. No compensation is payable for itinerary changes made for safety or operational reasons.

10. Photography and Media

By participating in our tours, you consent to:

  • Photography and filming for promotional purposes
  • Use of your image in our marketing materials
  • Sharing of tour experiences on social media

Please inform us if you do not wish to be photographed or have cultural or religious restrictions.

11. Intellectual Property

All content on our website, including text, graphics, logos, and images, is protected by copyright and trademark laws. You may not reproduce, distribute, or modify any content without written permission.

12. Privacy and Data Protection

Your personal information is protected under our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

13. Force Majeure

We are not liable for failure to perform services due to events beyond our reasonable control, including but not limited to:

  • Natural disasters and extreme weather
  • Government restrictions or closures
  • Terrorism or civil unrest
  • Pandemic or health emergencies
  • Transportation strikes or disruptions

14. Dispute Resolution

14.1 Complaints Process

  1. Contact our tour guide immediately during the tour
  2. Submit written complaint within 30 days of tour completion
  3. We will investigate and respond within 14 business days

14.2 Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

14.3 Alternative Dispute Resolution

We encourage resolution through mediation before pursuing legal action. We are members of the Tourism Industry Council Victoria dispute resolution scheme.

15. Third-Party Suppliers

We work with various suppliers including:

  • Accommodation providers
  • Transportation companies
  • Activity operators
  • Restaurant and catering services

These suppliers operate under their own terms and conditions. We are not liable for their actions or omissions.

16. Special Needs and Accessibility

We strive to accommodate participants with special needs. Please inform us of any requirements during booking. Some tours may not be suitable for participants with mobility limitations due to the nature of activities and locations.

17. Environmental Responsibility

We are committed to sustainable tourism and environmental protection. Participants must:

  • Follow Leave No Trace principles
  • Respect wildlife and natural habitats
  • Minimize environmental impact
  • Support local conservation efforts

18. Age Restrictions

Age restrictions apply to certain tours:

  • Minimum age of 8 years for most tours
  • Children under 16 must be accompanied by an adult
  • Some adventure tours have minimum age of 12 or 16
  • Senior participants may need medical clearance for certain activities

19. Communications

By booking with us, you consent to receive communications including:

  • Booking confirmations and itinerary updates
  • Pre-departure information and safety briefings
  • Post-tour follow-ups and feedback requests
  • Marketing communications (opt-out available)

20. Amendments to Terms

We may update these Terms of Service periodically. Changes will be posted on our website with the effective date. Continued use of our services constitutes acceptance of updated terms. For bookings made before changes, original terms apply unless safety-related modifications are required.
